Subject: 9828 1992-209 Lee, Marvin Date: Mon, 27 Feb 1989 12:20:00 -0500 1992-209 Marvin Lee ORDINANCE NO. 9828 AN ORDINANCE CLOSING AND ABANDONING KELLEY STREET LOCATED SOUTHWEST FROM GARFIELD AVENUE, BETWEEN WILLOW STREET AND DODSON AVENUE, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Kelley Street located southwest from Garfield Avenue, between Willow Street and Dodson Avenue, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Part of Kelley Street, a 50 foot wide unopened right-of-way beginning on the southwest line of Garfield Avenue 370 feet southeast of the intersection of the southwest line of Garfield Avenue with the southeast line of Willow Street, said point being the northeast corner of lot 14, block 3, Loveman's Addition to Orchard Knob, as shown by plat of record in plat book 2, page 2, ROHC, thence southeast some 5 feet with the southwest line of Garfield Avenue to the beginning of a cul-de-sac having a radius of 40 feet, the center of said cul-de-sac being in the center of Garfield Avenue 10 feet southeast of the centerline of Kelley Street, thence southeast some 51 feet with said cul-de-sac to the northwest line of Parcel 140-3, Chattanooga Housing Authority Orchard Knob Urban Renewal Project: TN.R-12, as shown by plat of record in plat book 39, page 165, ROHC, thence southwest 88.65 feet with the northwest line of said parcel 140-3, thence northwest 50 feet to a point in the southeast line of lot 14, block 3, said Loveman's Addition, thence northeast 108.75 feet with the southeast line of said lot 14 to the southwest line of Garfield Avenue, the point of beginning. Tax Map No. 146F-N-9.1 and 22. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 3. Reservation of an easement the width of the right-of-way for South Central Bell for the purpose of operating and maintaining its facilities in said right-of-way. 4. The areas reserved for utility easements must be kept free and clear of all structures. 5. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
